Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, software and proxy network operated by Hopto Networks Ltd. under the brand Proxy Hopto (the “Service”). By creating an account or using the Service in any way, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract under the laws of your jurisdiction. By using the Service, you represent and warrant that you meet these requirements and that the Service is lawful for you to use.

2. The Service

The Service provides authenticated access to a network of residential and datacenter proxy endpoints. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for the lifetime of the Service, subject to these Terms.

“Lifetime” means the operational lifetime of Proxy Hopto. We commit to publishing at least 90 days' advance notice on this page and our warrant canary if we ever decide to discontinue the Service. We make no representation as to a minimum duration.

3. Pricing & payment

• The lifetime license costs €399.99 (or the equivalent in BTC at the rate displayed at checkout). Pricing may change for new customers; existing licenses are unaffected.
• We accept Bitcoin on the main chain only. Payments are final and non-refundable. Due to the nature of Bitcoin, we cannot return funds even if we wanted to.
• We do not store payment cards. We do not use a third-party payment processor.

4. Account & security

You are responsible for safeguarding your account credentials. We recommend a unique, high-entropy password generated by a password manager. We cannot recover lost passwords because we do not store them in plaintext.

You are responsible for all activity that occurs under your account. Notify us immediately at abuse@proxyhopto.io if you believe your account has been compromised.

5. Acceptable use

We resist most use-policing because the alternative is to log traffic — which we will not do. However, the following are prohibited and will result in termination without refund:

• Production, distribution, storage or trafficking of child sexual abuse material (CSAM).
• Targeted harassment, doxxing, or threats of violence against identifiable individuals.
• Distribution of malware, ransomware, exploit kits, or unauthorised remote-access tooling.
• Operating botnets, command-and-control infrastructure, or DDoS amplification toward third parties.
• Using the Service to attack or attempt to compromise our network or our other customers.
• Bulk unsolicited messaging (“spam”) where prohibited by the destination network.

We do not police lawful research, journalism, scraping, geographic-bypass, sanctions-evasion review, competitive intelligence, market price discovery, or personal privacy use. You alone are responsible for ensuring your activity is lawful in your jurisdiction.

6. Suspension & termination

We may suspend or terminate your account, without notice and without refund, if (a) you breach these Terms, (b) we receive a credible report that your account is being used for activity listed in section 5, or (c) we are required to do so by a court of competent jurisdiction.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY GIVEN EXIT NODE WILL REMAIN AVAILABLE OR UNBLOCKED BY ANY GIVEN THIRD-PARTY. WE DO NOT WARRANT THAT USE OF THE SERVICE IS LAWFUL IN YOUR JURISDICTION.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL HOPTO NETWORKS LTD., ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR €100 IF YOU PAID NOTHING.

9. Indemnification

You agree to defend, indemnify and hold harmless Hopto Networks Ltd. against any claim, damage, loss, liability, cost or expense (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any third-party right.

10. Governing law & dispute resolution

These Terms are governed by the laws of the Republic of Seychelles, without regard to its conflict-of-laws rules. Any dispute arising out of or in connection with these Terms shall be finally settled by the courts of Victoria, Mahé, which shall have exclusive jurisdiction. You waive any right to participate in a class action.

11. Changes

We may update these Terms from time to time. Material changes will be announced on this page at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

12. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hopto Networks Ltd. and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions remain in full force and effect.
